Conditions De Vente
1. Un Prime d’Acheteur de 13 % sera facturé pour les enchères en ligne et 10% sur place.
2. Toutes les factures doivent être payées en totalité au plus tard le 16 août 2019
3. Date limite pour le retrait de tous les actifs est plus tard Jeudi 22 août à 17:00pm.
Le paiement total doit être reçu avant de l’enlèvement.

Rôle de l’Encanteur aux enchères en ligne:
Sous réserve de modifications et des modifications annoncées par l’encanteur au moment de la vente, toute personne participant à la vente doit être lié par les termes et conditions suivants:
1. Le solde du prix d'achat doit être payé en totalité dans le délai prévu aux présentes, en cas Conditions spécifiques. Tous les paiements seront sous forme d'espèces, carte de debit, carte de credit (Frais de 3.5%), par chèque certifié, traite bancaire ou virement. Les dépôts sur compte d'achats peuvent être effectués à l'avance de la vente. Les dépôts seront remboursés immédiatement après la vente si aucun achat est effectué.
2. Les taxes de vente seront versés à l’encanteur au moment de la vente. Les acheteurs qui demande une exemption des taxes doivent fournir une preuve satisfaisante à l’encanteur.
3. L’encanteur se réserve le droit de vendre l'objet de réserves et d'acheter pour le compte d'autrui, que ce soit par procuration verbale ou écrite, tous sous réserve de vente.
4. Toutes les ventes seront conclues lorsque le temps expire ou comme indiqué par l’encanteur et aucun acheteur peut révoquer par la suite son offre. Titre pour les lots achetés ne passera jusqu'au paiement total du prix d'achat est reçu.
5. Toutes les ventes sont finales, TOUS LES ITEMS SONT VENDU TEL QUEL ET SANS AUCUNE GARANTIE. LIBRE DE TOUTES CHARGES ET PRIVILÈGES. TOUS LES ITEMS DEMEURENT LA PROPRIETE DE CORPORATION COMMERCIALE CRESCENT JUSQU'AU PAIEMENT FINALE.
6. La vente sera invalidé seulement par l’encanteur. L’encateur n’est pas responsable pour une description erronée d'un article ou lot soit contenues dans un catalogue publicité ou autre. Le descriptions ont été préparés à titre de guide seulement et ne doivent pas être invoquées par l'acheteur pour exactitude. S'il vous plaît vérifiez les articles avant l’encan. L'acheteur est responable de faire sa propre inspection.
7. Aucun article doit être enlevé à moins payés en totalité et tous les articles achetés doivent être retirés dans le délai prévu aux présentes dans les événements Conditions spécifiques . L'acheteur est responsable de tous les coûts d'enlèvement et est responsable de tout dommage , y compris, sans limitation, tout dommage environnemental , causé pendant ou à la suite de l'enlèvement . Les acheteurs doivent se conformer à toutes les lois et règlements environnementaux et à toutes les exigences établies par le commissaire-priseur pour l'enlèvement d'articles , y compris exigences relatives à la liaison des déménageurs . S'il vous plaît se référer aux Conditions Générales d'Utilisation suppression prévus par les présentes.
8. Ce catalogue est destiné seulement comme un guide et l’encanteur ne donnent aucune garantie dans le cadre ci-joint.
9. Si, pour quelque raison que ce soit, l’encanteur est incapable de livrer un lot ou de toute documentation nécessaire à l'égard de tout lot , la seule responsabilité de l’encaneteur , le cas échéant , doit être le retour de toutes les sommes versées sur un tel lot unique.
10. Les acheteurs reconnaissent que Crescent Commercial Corporation ou associés ne sont pas les expéditeurs ou les exportateurs de tous les articles achetés sont expédiés à partir du site de vente.
MODALITÉS DE RETRAIT
1. Les acheteurs / Déménagements / Riggers sont responsables de retirer tous les articles achetés.
2. a. Tous résiliation de lignes de gaz sera déconnecté et plafonné par un installateur de gaz agréé.
b. Tous déconnecte ÉLECTRIQUES à faire en conformité avec les codes fédéraux, étatiques / provinciales ou locales .
3. Les acheteurs / Déménagement / Riggers doivent fournir à Crescent Commercial Corporation un certificat d'assurance de pas moins de $ 5,000,000.00 attestant la loi d'indemnisation des travailleurs et des employeurs d'assurance de responsabilité civile et de la couverture d'assurance de responsabilité automobile et complet ( blessures corporelles et les dommages matériels ) par personne et l'apparition de nommage CRESCENT CORPORATION COMMERCIALE ainsi que le nom et l'adresse l’encan.
4. Le représentant de site doit examiner tous les articles en cours de chargement et cochez la facture expédition .
5. Les acheteurs / Déménagements / Riggers seront tenus responsables de tous les coûts et dommages à la propriété ou des réparations à la suite de leur négligence .
6. Toute personne demandant l'accès au-delà de nos dates publiées est soumise à un taux journalier non - négociable.

Online Auction Terms & Conditions:
Subject to amendments and modifications announced by the Auctioneer at the time of the auction, any person participating in the auction shall be bound by the following terms and conditions:
A Buyers Premium of 13% will be in effect for on-line auction and 10% for Live Auction.
This sale is conducted and payable in Canadian Funds only.

All invoices must be paid in full no later than Friday August 16th by 11AM no later

No items may be removed during auction. NO EXCEPTIONS.

Removal will start on Thursday August 15th at 11am AND Ends Thursday August 22nd.

Payment must be received in full prior to removal.

All purchasers have until Thursday August 22nd at 5pm for removal of equipment.

Auctioneers announcements on day of sale take precedence over published information.

A deposit equal to 25% of purchases is required at the time of sale. The balance of the purchase price must be paid in full within the time period herein provided in paragraph 2 above. All payments shall be by way of cash, certified cheque, bank draft or wire transfer, Debit Card or Credit Card (3.5% Service Fee). Deposits on account of purchases may be made in advance of the auction. Deposits will be refunded immediately after the auction if no purchase is made. The Auctioneer reserves the right to put articles back up for auction if deposit is not received at or before time of sale.

Federal & Provincial Sales taxes shall be paid to the Auctioneer at the time of sale. Purchasers from outside of Canada claiming exemptions must provide a signed bill of lading. All Purchasers outside of the province of Quebec must provide proof of shipment by an independent transporter. No exemption for all Quebec customers.

All Articles will be sold to the highest bidder conforming to the bid process, provided that the Auctioneer reserves the right to sell articles by individual, group lots and in bulk, as he deems appropriate. The Auctioneer reserves the right to sell on behalf of third parties, its own account or on the account of others, whether by verbal or written proxy, all subject to prior sale. Should any dispute arise between two or more bidders or as to any bid, the lot in question may, at the Auctioneer`s discretion, be immediately put up again and resold. The Auctioneer shall regulate all matters relating to the conduct of the auction and his decision shall be final and binding on all bidders.

No purchaser may thereafter revoke his bid. Title to the lots purchased shall not pass until payment in full of the purchase price is received.

All sales are final, on an "AS IS – WHERE IS", "IN PLACE", "WITH ALL FAULTS" basis with no conditions or warranties, whether express, implied, statutory or otherwise including without limitation, warranties or conditions as to title, description, fitness for purpose, quantity, quality, merchantability, state, condition, location, or otherwise.

No sale shall be invalidated by reason of, and the auctioneer shall have no liability for, a misdescription of any article or lot whether contained in a catalogue advertisement or otherwise. Descriptions have been prepared for guide purposes only and shall not be relied upon by the purchaser for accuracy or completeness. Please inspect all items before bidding. Purchasers shall be deemed to have relied entirely upon their own inspection and investigations.

The purchaser shall be responsible for all costs of removal and shall be liable for any damage, including without limitation, any environmental damage, caused during or as a result of the removal. Purchasers shall comply with all environmental laws and regulations and all requirements established by the Auctioneer for the removal of articles, including requirements as to bonding of movers. Please refer to the Removal Terms & Conditions herein provided.

The Auctioneer reserves the right to refuse any applicant the privilege of bidding or attending at the auction and may revoke such privilege at any time.

If a purchaser fails to make payment or remove goods within the time periods herein provided in the Terms & Conditions, the Auctioneer may resell the article purchased by auction, private contract or otherwise, as the Auctioneer in his discretion deems advisable, and the purchaser shall be liable for the shortfall and all costs and expenses, including but not limited to interest rates (a minimum of 1.5% per month or 18% per cent per annum), legal fees, removal and storage (a minimum rate of $2.00 per sq. ft. per month) and commissions, incurred in such resale.

The Auctioneer is acting as agent only and is not responsible for the acts of his principals.

If for any reason whatsoever, the Auctioneer is unable to deliver any lot or any necessary documentation required in respect of any lot, the Auctioneers sole liability, if any, shall be the return of any monies paid on such lot only.

Bidders acknowledge that any auction site is a potentially dangerous place, with noxious, corrosive and pressurized substances being present, heavy equipment being operated and electric circuits being live. Every person at the Auction Site before, during and after the auction sale shall be deemed to be there at their own risk with notice of the condition of the premises, the activities on the premises and the conduct of third parties, and the Bidder shall so advise his/her agents and employees. No person shall have any claim against the Auctioneer, his agents, employees or principals for any injuries sustained nor for damages to or loss of property which may occur from any cause whatsoever.

Purchasers acknowledge that Auctioneer is not the shippers or exporters of any purchased items being shipped from the auction site.

These terms and conditions together with any amendments or modifications expressly made by the Auctioneer at the time of the auction constitute all the terms and conditions with respect to the sale of the articles at this auction. There are no representations, warranties, terms, conditions, undertakings, or collateral agreements except as hereinabove provided.
REMOVAL REQUIREMENTS:
The following are the removal terms & conditions for all Purchasers, their employees, riggers, contractors and agents; (who will be further referred to as "Purchasers/Movers/Riggers", who participate in the disconnection and/or removal of equipment/articles to abide by.
a. All invoices must be paid in full before commencement of removal. Riggers, please do not put business cards on machines.
b. Purchasers/Movers/Riggers are responsible to remove all articles purchased.
c. Purchasers/movers/riggers shall be responsible for proper disconnection and termination of all electrical, water and/or air lines to your equipment as stipulated by site representative; the shearing of anchor bolts flush with the floor; leaving your work area in broom swept manner; the erecting of safety barriers as required where pits or holes have been created as a result of equipment removal; the removal, off premises, of all hazardous waste or oil contaminants contained therein of purchased assets, in conjunction with all environmental laws; any specific terms or conditions indicated by the auctioneer at the time of sale.
d. Purchasers/movers/riggers are responsible for insuring that all termination of gas lines are disconnected and capped by a licensed gas fitter.
e. Purchasers/movers/riggers are responsible for insuring that all electrical disconnects to be done in accordance with any federal, state/provincial or local codes.
f. No article(s) shall leave the premises until all the aforementioned have been completed to the satisfaction of The Auctioneer site representative.
g. Riggers: quote your customers accordingly; you shall be liable for all costs in compliance with the above.
h. Purchasers/Movers/Riggers shall assume all responsibility and liability for any and all articles "staged" for shipment, before it leaves the premises.
i. Purchasers/Movers/Riggers must provide to The Auctioneers a certificate of insurance of not less than $5,000,000.00 evidencing statutory workers compensation and employers liability insurance and automotive and comprehensive liability insurance coverage (bodily injury and property damage) per person and occurrence naming The Auctioneer as well as the Auction name and address.
j. Where available, bridge cranes and/or hoists may only be used by certified crane operators with insurance and only with the expressed written permission of crane owner and/or The Auctioneer.
k. The Auctioneer site representative must examine all articles being loaded out and check off Purchasers shipping invoice.
l. Purchasers/Movers/Riggers shall be held liable for all costs and damages or repairs to property as a result of their negligence.
m. Hours of removal are Wednesday to Friday from 9:00am to 4:00pm, unless otherwise specified. Anyone requiring access beyond our published deadlines is subject to a non-negotiable per diem rate.
NO ARTICLE(S) SHALL LEAVE THE PREMISES UNTIL THE AFOREMENTIONED HAVE BEEN COMPLETED TO THE SATISFACTION OF THE AUCTIONEER EMPLOYEE/SITE REPRESENTATIVE.
